Client: The business or individual using the Services. End Customer: A customer of the Client whose data is used to send communications. Services: Automation, messaging, review requests, and related tools provided by Covert Desk. Platform: The software systems used to deliver Services (including GoHighLevel or similar CRM tools). Applicable Laws: All relevant Australian laws including privacy, spam, and consumer laws.
2. OUR SERVICES
Covert Desk provides automation and communication tools, including:
SMS and email review requests
CRM integrations and automation workflows
Customer communication systems
Review collection and related tools
The Services are provided to assist businesses in requesting customer feedback.
We do not guarantee:
Any number of reviews
Positive reviews
Business outcomes or revenue increases
3. USER ELIGIBILITY
You must:
Be at least 18 years old
Have authority to act on behalf of your business
Comply with all Applicable Laws
4. CLIENT RESPONSIBILITIES
4.1 Consent Requirements
You MUST obtain valid consent before contacting any End Customer.
You confirm that:
All recipients have opted in
Consent is documented and lawful
You comply with the Spam Act 2003
Failure to obtain consent is solely your responsibility.
4.2 Privacy Compliance
You must comply with:
Privacy Act 1988
Australian Privacy Principles (APPs)
You are responsible for:
Collecting data lawfully
Informing customers how their data is used
Ensuring lawful data sharing with us
4.3 Data Responsibility
You warrant that:
All data you provide is accurate and lawful
You have rights to use and share the data
You will not upload purchased, scraped, or illegal data
4.4 Use of Services
You must not:
Send spam or unsolicited communications
Harass or mislead recipients
Use the platform for unlawful purposes
5. USER REGISTRATION & ACCOUNTS
You are responsible for:
Maintaining account security
All activity under your account
We may suspend or terminate accounts at our discretion.
6. PAYMENTS & SUBSCRIPTIONS
Services may be subscription-based
Fees are payable in advance
Subscriptions renew automatically
You may cancel anytime, effective at the end of the billing cycle.
No refunds unless required under Australian Consumer Law
7. MESSAGING SERVICES
7.1 Authorisation
You authorise Covert Desk to send communications on your behalf.
Messages may include:

Email
Automated follow-ups
7.2 Content Responsibility
You are fully responsible for:
Message content
Timing and frequency
Compliance with laws
7.3 Opt-Out Compliance
You must ensure:
Opt-out requests are honoured
Contact lists are updated
7.4 No Guarantee of Outcomes
We are not responsible for:
Customer reactions
Negative reviews
Reputation impact
8. THIRD-PARTY INTEGRATIONS
Services may integrate with:

We are not liable for:
Third-party outages
Platform changes
Delivery failures
9. INTELLECTUAL PROPERTY
All content, systems, and software remain the property of Covert Desk.
You are granted a limited licence to use the Services.

Systems are not completely secure
You may request deletion at any time.
11. SERVICE LIMITATIONS

14. LIMITATION OF LIABILITY

Covert Desk is not liable for:
Loss of revenue
Loss of data
Customer disputes
Regulatory penalties
Our liability is limited to: Fees paid in the previous 30 days
15. INDEMNITY
You agree to indemnify Covert Desk against any claims arising from:
Lack of customer consent
Breach of privacy laws
Misuse of the platform
Legal claims from End Customers
16. AUSTRALIAN CONSUMER LAW
Nothing in these Terms excludes your rights under the Australian Consumer Law.
